I'm beginning to suspect that Merlin isn't in the tree and/or has never been in the tree. We've yet to even have seen Merlin getting trapped in the tree. And we know that [SPOILER]Merlin made a brief appearance in the season premiere as the usher when young Emma snuck into the movie theater [/SPOILER] (if anybody didn't realize).
